Daybreak Games certifies to the Privacy Shield for all Personal Information (i.e. information from which an individual can be directly or indirectly identified) that it processes and which is transferred from countries in the European Economic Area to the United States including Personal Information from customer /users.
Daybreak Games has certified that it adheres to the following Privacy Shield Principles of (1) Notice; (2) Choice; (3) Accountability for Onward Transfer; (4) Security; (5) Data Integrity and Purpose Limitation; (6) Access; and (7) Recourse, Enforcement and Liability in respect of any Personal Information received from the European Union or Switzerland.
The Daybreak Games Privacy Policy (https://www.daybreakgames.com/privacy) explains the purposes for which Daybreak Games processes Personal Information about customers/users, how to contact Daybreak Games regarding inquiries or complaints, as well as the types of third parties to which Daybreak Games discloses Personal Information and how and when individuals can limit such uses and disclosure. Customers / users are required to confirm their acceptance of the terms in the Privacy Policy before creating a user account.
If there is any conflict between the policies in this Privacy Shield Policy or our Privacy Policy, and the Privacy Shield Principles, the Privacy Shield Principles shall govern.
Where required by law, Daybreak Games will offer an individual the opportunity to choose whether Personal Information about them will be disclosed to a third party or used for a purpose incompatible with the purpose for which it was originally collected or subsequently authorized by them.
Daybreak Games is required to take certain steps when transferring Personal Information received from the European Union to third parties (such as including necessary contractual provisions in our third party contracts). Daybreak Games may be potentially liable in cases of onward transfer of EU or Swiss individuals' data received pursuant to the Privacy Shield to third parties, unless Daybreak Games proves that it is not responsible for the event giving rise to the damage.
Daybreak is also subject to the investigatory and enforcement powers of the Federal Trade Commission.
Daybreak Games may disclose your Personal Information to a third party in the event of any re-organization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of Daybreak Games' business, assets, or stock, including in connection with any bankruptcy or similar proceedings.
Consumers generally have the right to access their Personal Information. Daybreak provides its customers/users with reasonable access to the Personal Information associated with their accounts and the ability to correct, amend or delete such Personal Information as set forth in the Daybreak Privacy Policy.

Because of Daybreak Games' commitment to the protection of Personal Information, Daybreak Games periodically evaluates its privacy policies and procedures to implement improvements and refinements from time to time. When this Privacy Shield Policy is amended, Daybreak Games will revise the "last updated" date at the top of this Privacy Shield Policy.
